Idaho has some of the strictest gambling laws in the West. Its constitution bans gambling with three exceptions, and the only way to bet real money online from inside the state is pari-mutuel horse racing. Here is what’s legal, what isn’t, and where Idahoans can bet legally.

What is legal in Idaho?
Very little. Idaho’s constitution says gambling is “contrary to public policy and is strictly prohibited,” and then lists three exceptions: the state lottery, pari-mutuel betting, and charitable bingo and raffles. Article III, Section 20 goes further and expressly bans casino table games such as blackjack, craps and roulette.
Sports betting
Not legal. Sports betting is not one of the constitution’s exceptions, so legalizing it would take a constitutional amendment approved by voters. No bill to legalize sports betting had been introduced in the Idaho Legislature as of 2026.
Online casinos and poker
Not legal. Real-money online casinos and online poker have no legal basis in Idaho, and the constitutional ban on table games rules out the kind of iGaming offered in New Jersey or Michigan.
Horse racing
Legal. Pari-mutuel wagering is one of the constitutional exceptions and is regulated by the Idaho Racing Commission. Idahoans can bet on tracks nationwide through ADW apps that accept Idaho customers, including our partner AmWager (21+). See our Idaho horse betting guide for how it works.
Daily fantasy sports
Murky. DraftKings and FanDuel pulled their paid fantasy contests out of Idaho in 2016 after an attorney general’s opinion, and the state has never passed a law authorizing DFS. A few smaller operators accept Idaho players, but there is no state licensing or consumer protection.
Sweepstakes casinos

Prediction markets
Federally regulated exchanges such as Kalshi offer event contracts under the Commodity Futures Trading Commission rather than state gambling law. Lottery
The Idaho Lottery sells draw games and scratch tickets and is overseen by the Idaho State Lottery Commission. Its voluntary self-exclusion program covers lottery products.
Tribal casinos in Idaho
Idaho’s tribes operate casinos under a 2002 voter initiative that allows electronic gaming machines and bingo-based games, but not house-banked table games or sportsbooks. The largest include:
- Coeur d’Alene Casino Resort in Worley, run by the Coeur d’Alene Tribe, with more than 1,100 gaming machines.
- Clearwater River Casino & Lodge in Lewiston, run by the Nez Perce Tribe, with around 600 machines.
None of Idaho’s tribal casinos takes sports bets.
Where Idahoans can bet on sports legally
Sports betting apps work on where you are, not where you live. Drive across the border to a legal state, and if you are 21 or older you can register and bet while physically there:

Your account stops working the moment you cross back into Idaho. Winnings from out-of-state bets are still taxable in Idaho.
Offshore sites and why to avoid them
Because there is no legal sportsbook or online casino in Idaho, any site taking real-money sports bets or casino play from Idaho is an unlicensed offshore operator. They carry no US state oversight of fairness, no guarantee your funds are safe and little recourse if a withdrawal is denied. We do not recommend them.
Popular teams for Idaho fans
Idaho has no major-league franchise, but college sports run deep. Boise State football on the blue turf at Albertsons Stadium is the state’s biggest draw, with the Idaho Vandals and Idaho State Bengals adding college interest. Many Idahoans follow the Seattle Seahawks, Mariners and Kraken, or the Utah Jazz.
Taxes on gambling winnings in Idaho
Gambling winnings, including lottery prizes and pari-mutuel payouts, are taxable income. House Bill 40, passed in March 2025, set Idaho’s income tax rate at 5.3%. Federally, from the 2026 tax year the W-2G threshold rose to $2,000 and losses became deductible only at 90% of their value, capped at your winnings. Keep records and check with a tax professional.

Idaho gambling in 2027
Watch the Legislature, not the ballot
Any move toward sports betting would need a constitutional amendment, which in Idaho starts with a two-thirds vote in both chambers. No such resolution had been introduced as of 2026, so the 2027 session is the first place to look.
Prediction markets in neighboring courts
A federal judge in Utah ruled against Kalshi in August 2026, and Kalshi plans to appeal. That case, and others in the West, will shape whether sports event contracts remain available to Idahoans.
Big racing days
The Belmont Stakes returns to Belmont Park in 2027 and the Breeders’ Cup is held there in the fall, the headline events for Idaho’s legal ADW bettors.
Is sports betting legal in Idaho?
No. Sports betting is not one of the exceptions in Idaho’s constitution, and no legalization bill had been introduced as of 2026.
Is online gambling legal in Idaho?
Only pari-mutuel horse racing. Online casinos, poker and sportsbooks are not legal.
