UNFORTUNATELY for the gamblers of the east coast, South Carolina remains behind the curve when it comes to sports betting. While there has been little activity since PASPA was overturned in 2018, 2025 might finally bring some movement. Two proposals have been filed ahead of the January 14 legislative start date, hinting at a potential shift.

The first proposal, HJR 3353, is a constitutional amendment that would put the decision to voters. If passed, this proposal would allow in-person pari-mutuel betting, legal sports betting, and casino games, including slots and table games like craps. Proceeds from any gambling expansion would be allocated to highway, road, and bridge maintenance, construction, and repair.

The second proposal, HB 3625, is focused exclusively on sports betting. This bill would legalize digital wagering and cap the number of platforms at eight. Operators would face a 12.5% tax on gross gaming revenue and pay substantial fees, including a $100,000 application fee and a $1 million licensing fee. Notably, the bill emphasizes responsible gambling, dedicating 5% of tax revenue to initiatives addressing gambling-related problems.

However, there’s a catch: applicants must already be live in at least five US jurisdictions, which could limit smaller operators like Betr and Underdog from entering the market. Both proposals are still at the discussion stage, and it remains to be seen if South Carolina will finally step into the world of legal sports betting.

Betting in South Carolina

At present, all forms of sports betting remain illegal. While the proposed legislation is a step forward, South Carolina gamblers still face limited options. Crossing state lines remains the only viable way to access retail sports betting, with the nearest casinos in North Carolina offering in-person options.

For online sports betting, you’d have to head to Tennessee. Offshore sportsbooks claim to serve South Carolina residents, but these are not governed by US law, offering no consumer protection. Winning bets may not be paid out, and deposits are at risk of being lost.

There are no laws in place to permit online or land-based casinos. Social casinos remain an option, allowing players to enjoy games like blackjack and roulette for free, though no real money can be won. For traditional casino experiences, residents must travel to neighboring states.

The state’s only source of gambling income comes from the lottery, which was established in 2002. Tickets are only sold at licensed lottery retailers and you have to be 18 years old to make a purchase.

While there have been no official moves to outlaw daily fantasy sports games, they operate in a legally gray area, but events operated by the likes of FanDuel, Underdog Fantasy and DraftKings are open to South Carolina residents.
