Is sports betting legal in Nebraska?
Yes, in person. The Legislature authorized sports betting at licensed racetrack casinos with LB 561 in 2021, after voters approved racetrack casinos in 2020. WarHorse Lincoln opened Nebraska’s first sportsbook on June 22, 2023, and you must be 21 to bet.
Mobile betting is not available. No Nebraska tribal casino takes sports bets either; the Ponca Tribe’s Prairie Flower Casino sportsbook sits across the river in Carter Lake, Iowa.

A sixth racetrack casino, WarHorse South Sioux City, broke ground on August 27, 2026.
Retail gaming revenue is taxed at 20%, and 70% of that tax goes to property tax relief.
Online sports betting: the November 2026 vote
The Legislature tried and failed. LR 20CA, Sen. Eliot Bostar’s constitutional amendment for mobile betting, cleared first-round debate 27-16 in April 2025, then stalled and died when the session ended on April 17, 2026.
Supporters went to the voters instead. Two initiatives are on the November 3, 2026 ballot:
- A constitutional amendment permitting wagers through an internet platform run by an authorized operator.
- A statutory initiative tying online wagering to the six licensed racetracks, with up to two platforms each (12 statewide), in-state servers and a 20% tax.
Both need a simple majority and “yes” votes exceeding 35% of all ballots cast. The statute directs the Commission to adopt rules by June 1, 2027. Even if both pass, no app will be live in 2026. When Nebraska launches, expect national brands to partner with the racetracks, and our sportsbook coverage will follow.

Nebraska sports betting in 2027
The ballot result
Two online betting initiatives go to voters on November 3, 2026. Each needs a simple majority and “yes” votes above 35% of all ballots cast to pass.
Rules by June 1, 2027
If approved, the Nebraska Racing and Gaming Commission must adopt online wagering rules by June 1, 2027, with up to 12 platforms tied to the six racetracks and a 20% tax.
A sixth racetrack casino
WarHorse South Sioux City broke ground in August 2026, completing the map of racetrack licenses that would also anchor online betting.
Is online sports betting legal in Nebraska?
